I, Mouza- Noapara, Kolkata, West Bengal 700156, offers comprehensive auto services, such as maintenance and repair. These terms and conditions ("Terms") govern the use and access of our website https://ragilly.com/ ("Website")or other products or services in connection with the Application or Website ("Services"). The "Platform" is the collective name for the Website and Applications.

Ragilly("Company/we/us/our") and its Users ("User/you/your") are bound by these terms, which also control how you use the Platform to explore and/or use the Services that we make available on the Platform. You agree to be bound by these terms by accessing and using our Services, which creates a binding contract between you and the Company. If you do not agree to the terms, you must discontinue using or gaining access to our services. Prior written agreements with you are expressly superseded by these Terms. The Company requires that the User carefully read these terms and conditions ("Terms and Conditions" or "Terms") before accessing the Platform or using the Platform to avail of Services (as defined below).

The Company maintains the right to alter, modify, or amend the Terms at any time and will post the revised Terms at the URL https://ragilly.com/terms-conditionin order to comply with any applicable laws or regulations and for other lawful business objectives. You are urged to periodically check the Terms because it is your responsibility to evaluate them for any modifications. Any modifications to the Terms and Conditions are not required to be communicated to Users by the Company.Following the publication of the amended Terms and Conditions, it will be assumed that you have read, comprehended, and accepted the updated Terms and Conditions if you continue to use the Platform, Content (defined below), and/or Services. Any mention of the Terms and Conditions made in this document shall be to the most recent edition.

Nothing on the Platform should be used as a replacement for your own independent research. According to the Indian Contract Act of 1872, the Information Technology Act of 2000, the rules promulgated thereunder, and the revised sections pertaining to the electronic records in various other statutes as changed by the Information Technology Act of 2000, all of these Terms combined constitute an electronic record. There is no need for a digital or electronic signature because these terms were generated by a computer system.

DEFINITIONS

Reviews, photographs, photos, audio, video, location information, neighbouring locations, and any other types of information or data are all referred to as "Content" but are not exclusively so. "Your Content" or "User Content" refers to information that you post, share, or transmit over the Services, such as likes, ratings, reviews, pictures, messages, images, and other materials that you make available to the public or that are displayed in your user profile. The term "Ragilly Content" refers to all content that the Company develops and makes available in connection with the Services, excluding Your Content, including but not limited to visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports, and other usage-related data in connection with activities connected to your account.

The term "Estimated Cost" refers to the service provider's best estimate of the Service's probable cost. Cost estimation is to foretell the amount, expense, and cost of the resources needed to finish a task.

"Membership Plan(s)" refers to any subscription-based or other membership plans that the Company occasionally makes to Users through offline or online media. When making such offers, the terms, conditions, and costs of such programmes must be disclosed through the appropriate medium.

The term "Service(s)" refers to any services offered through the Platform, which are further defined under Clause 3 below. At the sole discretion of the Company, the Services offered through the Platform may occasionally change.

"User" or "You" refers to anyone who owns a car in an urban area, particularly a metropolis, and who is registered on the platform in order to use the platform's services (often after the manufacturer's warranty has expired).

SERVICES

The Company's Platform, made available as part of the Services, is a technology platform that enables Users of the Company's Platform to plan and schedule repair or maintenance services for your car or bike with independent third-party providers. Following the submission of your request, we might offer you a list of potential service providers along with details about their background.

For a fee, the company also offers towing assistance to get your car out of the jam and back on the road.

You agree that all of the aforementioned services are carried out by independent third parties who are not employees of the company and that the company does not offer any repair or maintenance services to its clients.

You understand that the Company cannot guarantee your car will be available for service/repair even after accepting and/or confirming an appointment. The company will use reasonable efforts to link you with an independent third-party service provider when you request an appointment, enabling you to get vehicle repair services at or close to your location.

You acknowledge that the price and turnaround time for the services/repairs are approximations based on your request.

SUPPORT

Along with a telephone and email support system, the company also provides an online FAQ database. If you need any help or support, you can reach out to us by contacting support@ragilly.com or phoning our hotline at +91 9999037844 (Monday through Sunday, 7 am to 9 pm).

Upon receiving a complaint during business hours, the Company will respond as soon as possible. Additionally, the Company must make all reasonable attempts to resolve the complaint within 7 days of receiving it. Any advice provided by the Company on how to use the Services should not be interpreted as a warranty.

The User understands and agrees that the Company will address and make an effort to resolve the complaint in accordance with the Company's standard policies and procedures; the User's disagreement with the resolution or method of redress shall not be interpreted as the Company's failure to address the complaint. Any advice provided by the Company on how to use the Service should not be interpreted as a warranty.

The Company will exercise the utmost caution and take all necessary safety precautions while in charge of your vehicle. In the event that the User's car is stolen while it is in the Company's care, the Company will take all appropriate steps and provide the User with the support they need to recover their car, including promptly notifying the User of the theft, immediately reporting the theft to the nearest police station, assisting the local authorities in their efforts to recover the vehicle, etc.

PROHIBITED USAGE OF THE PLATFORM

Users are forbidden from engaging in any illegal activity on the Platform, including, but not limited to, the following: intentionally posting any information on the Platform that is untrue, inaccurate, or incomplete; sending any unsolicited communications to other Users; violating or attempting to violate the integrity or security of the Platform; transmitting any information on or through the Platform that is disruptive or competitive to the provision of our Services; The laws of India forbid any illegal activities on the Platform.

The Company shall have the right to disable any information that violates this Clause 7 upon learning of it on its own or after being made aware of it by a party affected by it in writing or through an email signed with an electronic signature. We shall also be permitted to keep such information and related records for a period of at least 90 days in order to present them to governmental authorities for review. We reserve the right to immediately terminate your access or use rights to the Platform and Services and to delete any content that is in violation of any relevant laws, rules, or regulations or the Agreement (including the Privacy Policy) by a User.

You hereby consent to such transfer by us. We may disclose or transfer User-generated information to our affiliates or governmental agencies in such a manner as permitted or required by applicable law. According to the applicable laws, we will only transfer sensitive personal data or information, including any information, to another body corporate or a person in India or located in any other country if they uphold the same standard of data protection as we do or if the user has given their consent and the transfer is required for the performance of a valid contract between the Company or a person acting on its behalf and the user.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

The Company shall own and retain ownership of all remarks, criticisms, ratings, suggestions, ideas, and other submissions made to the Company on or through the Platform or in any other way related to your use of the Platform (collectively, the "Comments"). Such disclosure, submission, or offer of any Comments shall constitute an assignment of all worldwide rights, titles, and interests to the Company and shall not in any way restrict the Company's use of any Comments, whether for commercial or non-commercial purposes. As a result, the Company will have all of these rights, titles, and interests entirely and will not be constrained in any way in using any Comments for commercial or non-commercial purposes. The Company is not obligated to (1) keep any user comments confidential, (2) compensate users for any comments, or (3) reply to any user comments.

You acknowledge that none of the Comments you submit to the Platform will violate any third-party rights, including copyright, trademark, privacy, or other intellectual or personal rights. Furthermore, you acknowledge that none of the Comments you submit to the Platform will be or contain libellous, illegal, abusive, or otherwise objectionable information. Any Comments you make are and will continue to be totally your responsibility.

The Platform's operation cannot be interrupted, destroyed, or limited by any material that you upload, post, email, or otherwise communicate or transmit. If you breach these Terms or use our Platform or Services in an unlawful or dishonest manner, we may suspend or restrict your use of such features.

You acknowledge that neither you nor anyone acting on your behalf will, directly or indirectly, publish, post, or otherwise make any defamatory comments or remarks about the Company and its respective employees, clients, operations, or services in writing, verbally, or electronically. If you violate these terms or intimidate someone to do so, you are responsible for paying the company's losses as a result of your actions. The Company shall have the right to bring civil and/or criminal proceedings against you in accordance with the applicable law, in order to seek restitution for damages and losses and to hold you accountable for committing illegal defamation.

USER DATA

You guarantee and represent that all information you submit in conjunction with using the Platform is true, accurate, and complete, and that you'll keep it up to date on a regular basis. You acknowledge that we may suspend or terminate your use of and access to the Platform if any information you supply to us is untrue, inaccurate, out-of-date, or incomplete.

You consent to the Company collecting and using your information, technical data, and connected information in accordance with its Privacy Policy in order to verify the provided documents. The Company may transfer information and data about your use of the Services to its group companies and service providers to support your access to those Services and use that information and data for analytics, trend identification, and statistical purposes to further improve the effectiveness and efficiency of the Platform. You give your permission for your information to be used and shared in this way.

In accordance with applicable laws, the Company may be required to provide information on Users to law enforcement, the government, and similar entities in connection with criminal proceedings. You acknowledge and accept that the Company will have the right to disclose such information with the appropriate agencies or entities in such circumstances.

INTELLECTUAL PROPERTY RIGHTSINTELLECTUAL PROPERTY RIGHTS

The Company autonomously develops, maintains, and updates the Platform. You are using a licence we have given you to access the Platform when you do so. The Company or its licensors are the sole owners of all rights, titles, and interests in all text, graphics, audio, design, and other works on the Platform, as well as all intellectual property related thereto, including, among other things, the domain name, copyrights, the Platform's look and feel, the trade name and trademarks, patents, and designs. The owners of each and every trademark and brand name used by a third party and displayed on the Platform. Unless otherwise specified, all content on the Platform is for personal use only. The intellectual property of the Company, its affiliates, associates, and/or its third-party information providers is violated by any alteration of the material or use of the material included on the Platform for any commercial purpose. If a computer virus, bug, or other technical issue compromises the security or effective administration of the service, we retain the right to suspend or cancel the service at any time.

You understand and agree that no right (express or implied) is granted to you with regard to such Content by your use of the Platform or by your availing of any Services via or at the Platform. The Company reserves the right, at any time and for any reason, to alter or modify the Content.

LICENSE

The Company grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to (i) access and use the Applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information, and related materials that may be made available through the Services, in each case solely in connection with your use of the Services. All of these rights are granted subject to your compliance with these Terms. All rights not expressly granted in this agreement are reserved by the Company and its licensors.

Except as specifically permitted in the Terms and Conditions, you will not use, copy, adapt, modify, create derivative works based on, distribute, licence, sell, transfer, publicly perform, transmit, stream, broadcast, or otherwise exploit the Platform and Services. Except for the licences and rights expressly given in the Terms and Conditions, no licences or rights under any intellectual property rights owned or controlled by the Company or its licensors are impliedly or otherwise granted to you. The Company is the owner of the Platform and all related intellectual property rights.

CANCELLATION AND REFUND

You have no legal authority to ask for a refund or to cancel a service that has already been accepted by the Platform. You are not permitted to cancel an order once it has been placed (i.e., after the User accepts the projected cost), nor are you permitted to ask for a reimbursement for the Services received.

CONTACTING YOU

You consent to us contacting you by phone, email, SMS, or other means of communication in order to get your feedback on the Platform or our Services, get your opinion on any other Users listed there, or respond to any complaints, inquiries, or concerns other Users may have about your objectionable Content.

In response to the Company's letter, you promise to offer your complete cooperation.

By providing recommendations or other feedback regarding our Services/Platform, you consent to our use and sharing of that information without paying you any money and without any responsibility to keep it confidential.
